Terms of service
1. About us
This website is run by Socialcave Ltd, a company registered in England and Wales (number 16383008), registered office 15 James Wolfe Road, Cowley, Oxford OX4 2PY, United Kingdom. Contact us at info@socialcave.co.uk.
2. Using this website
The information on this site is general and may change. We work to keep it accurate but do not guarantee it is complete or up to date. Links to other websites are for convenience; we are not responsible for their content. Please do not misuse the site, for example by trying to gain unauthorised access or by sending spam through our forms.
3. Our services
Our services are for businesses, not consumers. When you accept our written quote or sign up to a bundle, a contract is formed made up of that quote and these terms. If they conflict, the quote takes priority.
4. Monthly bundles and add-ons
- Bundles and monthly add-ons are billed monthly in advance and have no minimum term.
- You can cancel with 30 days' written notice; email is fine.
- Setup fees cover onboarding work and are not refundable once that work has started.
- You can move up a bundle at any time, or down at the end of a billing month.
5. One-off projects
Each project is priced in a written quote that sets out what is included. Unless the quote says otherwise, we take 50% before work starts and the balance before launch or handover. Extra work outside the agreed scope is quoted separately before we do it.
6. Payment
Invoices are due within 14 days. If an invoice is overdue we may pause work until it is paid, and we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
7. Your responsibilities
You agree to give us accurate information, the content and access we need, and timely feedback and approvals. You confirm you have the right to use any material you send us, such as logos, photos and text. Delays in these things may move our delivery dates.
8. Advertising and third-party platforms
Advertising spend is paid directly by you to the platform, such as Google or Meta, and is not part of our fees. Platforms like Google, Meta, Shopify, WhatsApp and TikTok have their own terms, which you agree to when you use them. We are not responsible for their decisions, outages, policy changes or account suspensions.
9. Results
We use proven methods and report honestly, but nobody can control search engines, AI assistants or social platforms. We do not guarantee specific rankings, AI mentions, followers, leads or sales.
10. Ownership and our portfolio
Domains, websites, profiles and ad accounts we set up for you are registered in your name. Copyright in final deliverables passes to you once they are paid for in full. We keep ownership of our own tools, templates and know-how, and give you a licence to use any that form part of your deliverables. We may show your work in our portfolio unless you ask us not to.
11. Confidentiality and data protection
Each of us will keep the other's confidential information private. Both of us will comply with UK data protection law. Where we handle personal data on your behalf, such as your customer list, we do so only on your instructions, and we will sign a data processing agreement on request.
12. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited. Otherwise, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data. Our total liability under any contract is limited to the fees you paid us in the 3 months before the claim arose.
13. Ending our agreement
Either of us may end the agreement with 30 days' written notice. Either of us may end it straight away if the other seriously breaks these terms and does not put it right within 14 days of being asked, or becomes insolvent. When the agreement ends, and once all invoices are paid, we hand over your logins, files and accounts within 5 working days.
14. Changes and general terms
We may update these terms, and the version in force when you sign up applies until you agree to a new one. If any part of these terms is found unenforceable, the rest still applies.
15. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
